These General Terms and Conditions of Sale govern the distance purchase of products through the website SmartKits.eu. The Customer is required to read these conditions carefully before submitting an order.
Submitting an order and ticking the box "I have read and accepted the Terms and Conditions" constitutes a formal, binding agreement equivalent to a handwritten signature. The Customer declares they have the legal capacity to enter into this contract.
Pursuant to Art. 52 of Legislative Decree 206/2005 (Italian Consumer Code), the Consumer Customer has the right to withdraw from the contract within 14 days of receiving the goods. However, to ensure maximum transparency and protect the integrity of the products sold, any refund is strictly subject to compliance with the following clauses:
The right of withdrawal applies only if the product is completely intact. SmartKits SKs will not accept returns and will not issue refunds if:
Usage or Installation: The product shows signs of use, assembly, installation, or tampering (e.g., marks from wrenches/tools, grease, or scratches on the threads).
Condition of the Item: The product is not in the exact same condition in which it was received, making it impossible to resell as "new."
Original Packaging: The manufacturer's original packaging (box, sealed wrap, labels) is considered an integral part of the product. The return will be rejected if the original box is torn, written upon, damaged, or has shipping labels/adhesive tape applied directly to it. (We strongly recommend placing the original product box inside a second protective shipping box).
Customer Responsibility: Shipping costs for the return of the goods are the exclusive and total responsibility of the Customer.
Liability: The shipment, until the certificate of receipt at our warehouse is issued, remains under the full responsibility of the Customer. SmartKits SKs is not liable for damage, theft, or loss of goods returned via uninsured shipping methods.
In the event that the right of withdrawal is correctly exercised:
Upon receipt of the goods, SmartKits SKs will conduct a technical inspection to verify the integrity of the item and its packaging.
If the conditions in Section 2.1 are met, the refund will be issued within 14 days.
Disputes (PayPal/Gateways): In the event of a claim opened through third-party entities (PayPal, Stripe, Banking Institutions), SmartKits SKs will submit this contractual documentation and the technical inspection report (including photos/videos of the return unboxing) to demonstrate any loss in value of the item or improper use by the customer, requesting that the claim be closed in favor of the Seller.
Upon delivery, the Customer must inspect the condition of the packaging.
If the package is dented, wet, or appears suspicious, the Customer must sign the delivery receipt with a "Specific Reservation of Control," describing the damage (e.g., "box crushed on the right side").
In the absence of such a reservation, claims for damages caused by the carrier cannot be accepted, and any request for a refund for a "damaged product" will be rejected.
Any manufacturing defects must be reported within 14 days. The warranty does not cover damage caused by incorrect installation or use that does not comply with the technical specifications of the spare part. Every contested item will be sent to the manufacturer for verification; if the manufacturer denies a factory defect, all transport costs will be charged to the Customer.
For any dispute concerning the application, execution, or interpretation of this contract, the Court of Catania (Italy) shall have exclusive jurisdiction.
