Acceptance of this contract implies full knowledge and agreement with the terms expressed herein. During the purchase or registration phase, selecting the checkbox "I have read and accepted the general terms and conditions of sale" is considered, for all intents and purposes, a handwritten signature by the user.
Procedure: Purchases are made by adding products to the virtual cart and completing the checkout process. Registration is required to manage orders and track shipments.
Pricing: All prices are expressed in Euros, VAT included (22%). SmartKits SKs reserves the right to modify prices at any time; the applied price will be the one in effect at the time of order confirmation.
Retention of Title: Products remain the property of SmartKits SKs until full payment has been received.
PostePay: Advance top-up within 7 days of the order. Send confirmation to SmartKits@SmartKits.net.
PayPal: Immediate secure transaction. In case of cancellation or non-acceptance, the refund will be issued to the original PayPal account.
Bank Transfer: Orders will be processed only after the actual credit is received (usually 1-3 business days).
Satispay: Immediate transaction. In case of cancellation or non-acceptance, the refund will be issued to the original Satispay account.
Product images are indicative; manufacturers may make improvements or modifications without prior notice. Important: Upon delivery, the Customer is required to check the integrity of the package. In case of evident damage to the packaging, the Customer must sign the delivery receipt with a "Specific Reservation of Control" (Riserva di controllo specifica), describing the anomaly. Without such a reservation, it will not be possible to file a claim against the carrier for hidden damages.
This information notice governs the right of withdrawal and the return procedures for purchases made on the website smartkits.eu, in accordance with Directive 2011/83/EU on consumer rights, as amended by Directive (EU) 2023/2673 (concerning distance contracts), and Italian Legislative Decree no. 206/2005 (Italian Consumer Code).
a. Right of Withdrawal
If you are acting as a "Consumer" (i.e., a natural person purchasing goods for purposes unrelated to their professional, commercial, or trade activity), you have the right to withdraw from the purchase contract, without having to provide any reason, within 14 calendar days.
The withdrawal period shall expire after 14 days from the day on which you, or a third party other than the carrier and indicated by you, acquires physical possession of the goods. In the case of multiple goods ordered in a single order and delivered separately, the period shall run from the day on which you acquire physical possession of the last good.
b. How to exercise the right of withdrawal (Article 11a of Directive 2011/83/EU)
In accordance with Article 11a of Directive 2011/83/EU, to facilitate the exercise of the right of withdrawal, smartkits.eu provides a simplified withdrawal function directly on the website ("Withdrawal Button").
You can exercise your right of withdrawal through one of the following methods:
Option A: Use of the online withdrawal button (Recommended)
You can access the online withdrawal function by clicking on the "Withdraw from Contract" button within your personal area in the "My account" section.
Once you have filled out the digital form with the required details (first name, last name, email address, order number, and description of the spare part you wish to return) and submitted the request, you will immediately receive an acknowledgment of receipt on a durable medium (via email).
Option B: Explicit declaration
You can send an explicit declaration of your decision to withdraw from the contract via:

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the 14-day period has expired.
c. Effects of Withdrawal and Refund
If you withdraw from the contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed of your decision to withdraw.
We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
Retention of refund: We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

Shipping costs: You will have to bear the direct cost of returning the goods.
e. Condition of goods and Diminution of Value (Specifics for Car Spare Parts)
The shipment and integrity of the spare part are under your responsibility until received at our premises.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

These General Terms and Conditions of Sale govern the distance purchase of products through the website SmartKits.eu. The Customer is required to read these conditions carefully before submitting an order.
Submitting an order and ticking the box " (Read the Terms of Service)" constitutes a formal, binding agreement equivalent to a handwritten signature. The Customer declares they have the legal capacity to enter into this contract.
Pursuant to Art. 52 of Legislative Decree 206/2005 (Italian Consumer Code), the Consumer Customer has the right to withdraw from the contract within 14 days of receiving the goods. However, to ensure maximum transparency and protect the integrity of the products sold, any refund is strictly subject to compliance with the following clauses:
The right of withdrawal applies only if the product is completely intact. SmartKits SKs will not accept returns and will not issue refunds if:
Usage or Installation: The product shows signs of use, assembly, installation, or tampering (e.g., marks from wrenches/tools, grease, or scratches on the threads).
Condition of the Item: The product is not in the exact same condition in which it was received, making it impossible to resell as "new."
Original Packaging: The manufacturer's original packaging (box, sealed wrap, labels) is considered an integral part of the product. The return will be rejected if the original box is torn, written upon, damaged, or has shipping labels/adhesive tape applied directly to it. (We strongly recommend placing the original product box inside a second protective shipping box).
Customer Responsibility: Shipping costs for the return of the goods are the exclusive and total responsibility of the Customer.
Liability: The shipment, until the certificate of receipt at our warehouse is issued, remains under the full responsibility of the Customer. SmartKits SKs is not liable for damage, theft, or loss of goods returned via uninsured shipping methods.
In the event that the right of withdrawal is correctly exercised:
Upon receipt of the goods, SmartKits SKs will conduct a technical inspection to verify the integrity of the item and its packaging.
If the conditions in Section 2.1 are met, the refund will be issued within 14 days.
Disputes (PayPal/Gateways): In the event of a claim opened through third-party entities (PayPal, Stripe, Banking Institutions), SmartKits SKs will submit this contractual documentation and the technical inspection report (including photos/videos of the return unboxing) to demonstrate any loss in value of the item or improper use by the customer, requesting that the claim be closed in favor of the Seller.
Upon delivery, the Customer must inspect the condition of the packaging.
If the package is dented, wet, or appears suspicious, the Customer must sign the delivery receipt with a "Specific Reservation of Control," describing the damage (e.g., "box crushed on the right side").
In the absence of such a reservation, claims for damages caused by the carrier cannot be accepted, and any request for a refund for a "damaged product" will be rejected.
Any manufacturing defects must be reported within 14 days. The warranty does not cover damage caused by incorrect installation or use that does not comply with the technical specifications of the spare part. Every contested item will be sent to the manufacturer for verification; if the manufacturer denies a factory defect, all transport costs will be charged to the Customer.
For any dispute concerning the application, execution, or interpretation of this contract, the Court of Catania (Italy) shall have exclusive jurisdiction.
